Temporary Work; Subclass 457 Visa
Temporary work visa allows you to work in the nominated occupation for your approved sponsor /employer in Australia for up to 4 years.
To apply for this type of visa, you will either need to register your EOI at SkillSelect or you can apply directly if you have an approved business sponsor and the your business sponsor's nominated occupation is also approved by DIBP.
Business Sponsor
Standard business sponsorship arrangement is the most common type of business sponsor in using this type of visa application.
To becomes a standard business sponsor, the business:
- is a lawfully operating business
- meets training requirements (Australian businesses)
- Agrees to the number of subclass 457 workers to be nominated
- Have no relevant adverse information against the business.or
- is an overseas business need a skilled worker to set up a business or business operation with connections with a business located outside Australia.
- fulfill or help in fulfill a contractual obligation (such as after sales services or maintenance services.)
Nomination
To nominate a position to be filled by a skilled worker from overseas, the information requires to provide are:
- Nominated an occupation as in the Consolidated Sponsored Occupation List (CSOL)
- The occupation is relevant to the position to be filled.
- The skills and experience required for the position
- The market salary rate for the position and the salary rate to be paid on the nominated position.
- The nominated employee details
- The location of nominated employee will be working
Visa application-457 visa
Applicant applying for this class of visa requires:
- be nominated to work in an approved occupation as listed in CSOL.
- Has the skills require for the nominated occupation.
- Be able to meet relevant authority's registration and licensing requirements.
- Has IELTS score of at least 5 in each of the 4 components-Speaking, reading, writing or listening. or
- Score at least "B" in Occupational English Test (OET). -English language requirements may be waive if applicant meets certain criteria or- 5 years of full time study in a secondary or higher education institution where medium of instruction is English
- Meet health requirements
- Have adequate health insurance
- Meet character requirements.
Further Direction:
At the end of your 4 years Temporary Work; Subclass 457 visa, it is possible for you to make a new application for this class of visa if your employer is still willing to continue sponsoring you in the application and both you and your employer are able to meet the visa criteria at the time of application for this class of visa.
Alternatively,
if you have been working for your nominated employer for 2 years while holding the 457 visa and Your employer has nominated you for a permanent position and the nomination has been approved by DIBP, it is possible for you to apply for a permanent resident visa under:
- Employer Nomination Scheme; Subclass 186 Visa or
- Regional Sponsored Migration Scheme; Subclass 187 Visa.
Regional Sponsored Migration Scheme; Subclass 187 Visa
To apply for Regional Sponsored Migration Scheme under Temporary Residence Transition Stream, you will need to meet the criteria as listed below:
- nominated by an approved Australian employer whom you have been working for 2 years in a nominated occupation while holding a 457 visa.
- Received an permanent position offer by the nominated employer.
- Under the age of 50 unless exempted.
- Hold the necessary registration, license or professional membership.
- Has IELTS score of at least 5 in each of the 4 components-Speaking, reading, writing or listening. or
- Score at least "B" in Occupational English Test (OET).
-English language requirements may be waive if applicant holding passport issued by UK, US. Canada, NZ or Republic of Ireland or
- 5 years of full time study in a secondary or higher education institution where medium of instruction is English
- That the position offer is located in regional Australia.
Employer Nomination Scheme; Subclass 186 Visa
To apply for Employer Nomination under Temporary Residence Transition Stream, no skills assessment is requires. You will also need to be:
- nominated by an approved Australian employer whom you have been working for 2 years in a nominated occupation while holding a 457 visa.
- Received an permanent position offer by the nominated employer.
- Under the age of 50 unless exempted.
- Hold the necessary registration, license or professional membership.
- Has IELTS score of at least 5 in each of the 4 components-Speaking, reading, writing or listening. or
- Score at least "B" in Occupational English Test (OET).
